Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Lead Peak CRM platform (“Service”). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree, you must not use the Service.
1. About the Service
Lead Peak is a Software-as-a-Service (SaaS) Customer Relationship Management (CRM) platform designed for travel agencies and travel businesses.
The Service is operated by Netgen IT Solutions Pvt. Ltd., a private limited company registered in Shimla, Himachal Pradesh, India.
2. Eligibility
- You must be at least 16 years of age to use the Service.
- You may use the Service for business purposes related to travel operations.
- By registering, you represent that the information you provide is accurate and complete.
3. Free Trial
- Lead Peak offers a 30-day free trial.
- Trial extensions may be granted at our discretion.
- During the trial, full functionality may be available unless stated otherwise.
- Trial user data is retained for 90 days after trial expiry, after which it may be archived.
- Users may request a copy of their data at the end of the trial period.
4. Paid Plans & Payments
- Continued use after the trial requires subscription to a paid plan.
- Payments are made online within the web application using a payment gateway.
- Fees, billing cycles, and applicable taxes will be displayed before payment.
5. User Accounts
You are responsible for:
- Maintaining confidentiality of your login credentials
- All activities performed under your account
- Promptly notifying us of unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms.
6. Acceptable Use
You agree not to:
- Use the Service for illegal or unlawful purposes
- Send spam or unsolicited communications
- Upload malicious code or harmful content
- Attempt reverse engineering, scraping, or unauthorized access
- Misuse WhatsApp or messaging features in violation of applicable laws
7. User Data & Content
- You retain ownership of all data you upload to the Service.
- You grant us a limited license to process your data solely to provide the Service.
- We act as a data processor for customer data stored within your account.
8. Data Retention & Deletion
- Users may request:
- A copy of their data
- Permanent deletion of their account and data
- Account deletion requests must be submitted to support.
- Archived data may be permanently deleted after retention periods.
9. Third-Party Services
The Service may integrate with:
- Google Analytics (website analytics)
- ZeptoMail (transactional emails)
- WhatsApp Business API (Meta)
We are not responsible for outages or changes in third-party services.
10. Service Availability
- The Service is provided on an “as-is” and “as-available” basis.
- We do not guarantee uninterrupted or error-free operation.
- We may modify or discontinue features without notice.
11. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- Our liability is limited strictly to service availability
- No guarantees are made regarding business outcomes or revenue
12. Suspension & Termination
We may suspend or terminate access if:
- These Terms are violated
- Payment obligations are not met
- Abuse or misuse of the Service is detected
Users may request account termination by contacting support.
13. Governing Law
These Terms are governed by the laws of India, including the Information Technology Act, 2000.
Courts in Himachal Pradesh, India shall have exclusive jurisdiction.
